In the case of occasional private practice, the basic group professional liability insurance plan contract also provides an engineer who meets certain requirements a coverage of $250,000 per loss and $500,000 for all losses resulting from professional services rendered in respect of a single project. The requirements are:
- He renders, alone and on his own account, professional services. The term “alone and on his own account” describes a self-employed worker or an engineer who works alone for a sole proprietorship, and not for a partnership or a legal entity (e.g. an incorporated business);
- His charged fees are equal to or less than $15,000 for all professional services rendered during a 12-month period beginning 1 April of each year.
Junior engineers, engineers-in-training and temporary restrictive engineering permit holders cannot be covered by the basic group professional liability insurance plan for occasional private practice because they do not engage in professional activities alone, but rather under the immediate control and supervision of an engineer. Therefore, they must subscribe to the group supplementary professional liability insurance plan contract entered into by the OIQ.
